What are Form E and CP8D, and when are they due?
Form E is the employer's yearly return and CP8D lists each employee's pay. LHDN says both are due by 31 March of the following year. For YA 2025, one guide listed 30 April 2026 as the e-Filing date, so check the calendar for any grace period.
Employers report to LHDN every year on what they paid their staff.
- Form E: the employer's return, filed through e-Filing.
- CP8D: the detailed employee remuneration data. LHDN says Form E is only complete if CP8D is submitted in time, and employers who already sent data through e-Data Praisi do not need to submit CP8D separately.
- EA/EC statement: the employer must give each employee their remuneration statement by the last day of February.
- CP58: the statement of incentive payments to agents, dealers and distributors, due by 31 March.
Deadline: 31 March of the following year, per LHDN's employer page. L & Co's YA 2025 guide lists 30 April 2026 for Form E e-Filing, which reflects the usual e-Filing grace period; do not count on a grace period unless LHDN announces one.
Penalty: failing to comply can lead to a fine of RM200 to RM20,000, up to six months in prison, or both under s.120(1) of the Income Tax Act, though LHDN normally begins with notices.
Preparation: collect payroll, EPF and SOCSO, benefits-in-kind and PCB records early. An employer number is needed to file.
